Summary: Brand Protection is a proactive initiative to protect patient safety, supply chain integrity and brand reputation by identifying and acting on individuals or entities that intend to mislead healthcare practitioners, caregivers, patients, trade organizations or the public at large for their own illegal gain. The Director, Brand Protection is responsible for creating a global brand protection program, directing ongoing monitoring, overseeing anti-counterfeiting and illegal diversion investigations related to (company) products, supporting enforcement activities, managing key external partnerships, and assessing and reporting progress to senior leadership. The incumbent will be responsible for providing strategic advisory services to senior management in order to minimize business risks associated with supply chain security and brand protection related activities. The successful candidate must excel at working in a collaborative, diverse, complex, resource-constrained environment and be able to drive decision-making processes that involve multiple constituencies and constraints. Responsibilities will include, but are not limited to the following: • Develop, support and lead Product Security Integrity strategy and related initiatives to include anti- counterfeiting programs, misrepresentation of product matters and tampering/sabotage investigations. • Serve as the single point of contact for orchestrating Brand Protection activities across the Commercial organization. Acts as the Subject Matter Expert (SME) in all aspects of pharmaceutical brand protection strategies. • Direct online and offline monitoring of suspect products, diversion, trademark infringement, and promotional abuse in global markets, maintain expert familiarity with core industry trends, including customer, competitive and enforcement dynamics in order to adapt and support various aspects of Brand Protection. • Provide proactive intelligence collection relating to pharmaceutical crime. • Develop and leads multidisciplinary, cross-functional Product Security Steering Committee and Product Security Team that includes senior management and SME’s from Quality, Commercial, Legal, Security, Patent Counsel and Technical Operations. • Leads the development of a communication plan that keeps internal stakeholders appropriately informed of Brand Protection initiatives and progress reports. • Provide senior management with timely, reliable and well structured information regarding brand protection initiatives including tracking of KPI’s, variance analysis and contingency plans for corrective measures. • Monitors and tracks illegal distributors, off market sales and online pharmacies selling Celgene products illegally. • Prioritize monthly targets for suspect product purchase. • Investigate entities for violations of applicable regulations, trademark/copyright infringements, product format/packaging and pricing. • Collaborate with key stakeholders to take appropriate enforcement actions. Coordinate and execute communications strategies (warning letters) and track response to key actions. • Lead global anti-counterfeiting initiatives ensuring measures are technologically sound. Consult with key stakeholders, both public and internal, to communicate product security initiatives. • Conduct “For Cause” audits for high risk suppliers. • Ensure reporting procedures and requirements have been instituted to document investigations to memorialize pertinent information received from various sources of information. Ensure reporting meets regulatory requirements. • Develop metrics to measure and track accomplishments consistent with strategic plan. • Develop and maintain a network of knowledgeable and influential persons in government, law enforcement, security, intelligence, and internal functions. • Provide Supply Chain due diligence and investigative support to the business. Establish key suppliers to provide support services including research, security surveys and investigations to meet the needs of the product security program.. Scope: • Span of Control – Global supply chain for commercial, R&D and investigational products and related operations • Interacts with – Global Head of Supply Chain Security as well as senior management across Technical Operations, Quality O perations, Finance, Legal and IT functions. Skills/Knowledge Required: • Bachelor’s degree in criminal justice/business administration or a related field. Advanced degree (MS/MBA) and/or professional security certification (i.e. CFE, CPP, PSP etc.) preferred. • Minimum 10 years’ experience in global brand protection and/or corporate security preferably within the pharmaceutical industry. Prior experience in criminal justice and/or investigations related to product tampering, product counterfeiting, fraud, etc. is a plus. • Superior verbal/written communication abilities. • Ability to champion new ideas or positions to meet key goals and initiatives. • Experience in forecasting and building predictive models and risk assessments to understand impact of illegal diversion on egitimate trade channels. • Basic understanding of online promotional activities, search engine marketing and social media environments. • Strong commitment to patient safety and compliance requirements. • Basic understanding of commercial pharmaceutical operations and related supply chains including regulatory requirements (i.e. GxP, Track & Trace, etc.). • Superior audit and investigative skills to evaluate supply chain security risks as well as security program compliance. • Must possess and demonstrate strong leadership, communication and analytical skills. • Must possess the ability to be a self-starter and work independently with internal and external groups on multiple simultaneous projects. • Willing to travel 20 – 40% domestically and internationally occasionally on short notice.
