Hi, As far as patent filing and conditions required for patent filing, it will vary from country to country. Its a very vast topic and i will try to cover in next workshop but in this workshop, you will get some basic idea and understanding of patent in general.

I would like to know the differences between the patent application for India, USA and Europe

Dear Rameez, For patent application is concerned each country has their own patent law and procedural aspect for patent filing. In india and US there is a provision of filing provisional patent application while in Europe, its not. In india and EU, there is provision of opposition of patent either pregrant or post grant while in US its not there. Invention which are not patentable are different form country to country as per their national patent law. (Like you can not get patent on software and business method in india but you can get it in us and eu) There so many differences, but the major i have discussed.

Hello Mam, Its nice that all the members are aware about the importance of subject and eager to learn more about relevance of patent in their respective field. For natural product there are certain limitation in indian patent act for which you can not get patent but there are so many things related to natural product where one can file patent and get patent. Hi Swtherry, The easiest way to protect ur invention is to go PCT route but is quite costly. Other way is to go by paris convention route.

Dear Rabia There are namely 3 criterias for patentable subject matter 1. Novelty 2. Non Obviousness/Inventive step 3. Industrial applicability The rigour & interpretation is more or less simmilar Countrywise.

Hi Rabia, This webinar will give you answer of your questions. Regarding patentability criteria its remain same for all country law but interpretation will differ from country to country as per their regional patent laws.

Dear Dr. Samir If your research work has been published before filing atleat provsional appplication with ur consent then it will affect the patentability of ur work Indian Patent law states A prior publication of an invention before its priority date will not be deemed as anticipation, if the patentee or the applicant proves that the matter was obtained from him or the inventor or assignor, and that the publication was done without their knowledge, and the application for patent was therefore made immediately after learning that the publication had happened. This provision will not apply if the invention was commercially worked in India, otherwise for the purpose of reasonable trial before the priority date of the claim by the inventor, patentee or applicant, their assignor or assignee or some one else having their consent.

Dear Piyush, Thanks for your comment but you have missed something in the discussion as even after publication by consent of inventor, he can file patent without any problem if he file the patent application within prescribed time limit as specified in indian patent act.
